Auto Accidents and damages?

*Monika F asked:

I was in a car accident last friday and i was fine but my head and neck hurt so i went to the hospital to get some help. They did xrays and i had to go to a ciro b/c my neck is out of place and its straighten up. I have to attend massages and rehab and im lucky this was none of my fault, so the guy that caused everything is covering my bills.
I was wondering what has to be done to go to court and see if i could get some money for my neck’s damages caused in the accident because i cant even work til the end of the month – if im better by then.
Do i need a lawyer and how much do they charge and how long would that take if i have a chance in getting some money…thank you.

your insurance company should take care of this.
tell them the medical damages (bills).
thats what they get paid for.

You do not have to go to court. You need to contact the other party’s insurance company and file a bodily injury claim. Who referred you to a chiro? Why aren’t you going to a orthopedic doctor and/or physical therapist?

Also, just because you may have been injured does not mean that you are entitled to monetary compensation. The threshold requirements vary from state to state. Some are verbal, others are monetary, and in some states you need to sustain a serious injury. The definition of serious also varies.

Since the accident only occurred one week ago, you should concentrate on healing. Filing suit should be the least of your concern.

You can hire an attorney. They generally take about 1/3 of any settlement. No settlement will be considered until you have stopped treating and have reached a medical end result. Settlement does not happen overnight. If you and/or your attorney have unreasonable expectations, your claim/lawsuit could drag out for several years.

You have a soft tissue injury that will, in time go away. What you should be doing is approaching the other parties carrier for a Bodily Injury claim.

Trust me, this is not a get rich quick situation. Large settlements are for fatalities, scarring, loss of limbs…………….injuries that matter.

It’s not advisable to get it on the court. Just try to talk to your car insurance provider and the others party car insurance company for the best thing to do.
