Can an employer fire you after a car accident while working?
Jesuslovesyou asked:
I do delivery for dominos pizza. I got fired yesterday after suing my employer just 2 months ago. The manager was bitter against me for calling him in court because he wasn’t willing to pay my medical bills after I a car accident. Y were they so angry since it’s worker’s comp?

I’ll tell my lawyer that and they possibly will go to court. What do you think will happen? Will they have to pay me for some time? I had 2 jobs

It is illegal to fire you while you are on workers comp. Call your attorney and tell them what happened.
The employer is angry because his workers compensation insurance rate will go up because of your claim.
How much and how long you get paid, you have to ask your attorney. But tell your ASAP that the guy fired you. That is illegal.
I’m pretty sure you’ll atleast get unemployment benefits out of them. All jobs anymore are all buddy system BS and if ur not in the buddy circle, well…. Hope u get a big settlement however unlikely it may be. I’m tired of hearing about my friends and everyone getting booted bc MR.Manager did something wrong and is ill bc he got in trouble for it.
Dominos is a franchise. It’s highly possible that your particular store didn’t have coverage, so had to pay out of pocket.
But it’s pretty reasonable, and logical, to think that an employee will get fired, for SOME reason, after suing the employer.
If you sue your friend, I don’t think you can expect a Christmas card from them any more. Same thing for an employer.
Most likely, they can fire you. It’s highly doubtful you are a member of a union, or have a written employment contract with them.
**And it’s not illegal to fire you while you’re out on workers comp. Unless you are a union employee, and/or have a written contract that says otherwise, an employer does NOT have to hold your job open for you, while you are out.**
It is illegal to fire someone for filing a worker’s comp claim.
It is not illegal to fire a person whose job involves driving for having an accident. Companies that employ drivers can, and should, try to employ only drivers who can (and do) make there deliveries without having accidents.
