Can someone sue you if they were paid by the auto insurance company and the accident was two years ago?
mary c asked:
I am getting sued for 40,000 over a car accident from 2 years ago. I was driving a car in someone else’s name and they had full coverage and it should have paid him. I dont understand why he has chosen to sue me as well. I dont have anything. I am a single mother who is looking for a second job. Do I need to hire a lawyer?

Of course you can be sued. It would appear that the person was not fully pleased with what the insurer paid. If the insurance company did not provide an ample settlement, both you and the owner of the car can be successfully sued. Yes, you need to get an attorney to answer the complaint. If you do not, you will automatically be found at fault and the judgment lodged against you.
Unless it was YOUR insurance company that paid out, yes, you can be sued. If someone else’s insurance paid out, you will likely be sued by their insurance company. Just because their insurance paid out, doesn’t get you off the hook for your damages! Their insurer is going to come after YOU for reimbursement.
Can you AFFORD a lawyer? If so, hire one. If not, you’ll just have to show up in court. You’ll probably lose either way, and yes, there will be a judgement against you. They may try to attach your wages, if you have no assets.
do you have auto insurance?? if so, call them asap and report this. they will hire a lawyer for you at no charge.
if no auto insurance, then i suggest you find a lawyer to represent you. it could be that they are looking for more money than they got from the owner of the car and now looking to you for the balance. this could be any assets you have, garnishment from any jobs etc.
if no response, a judgment will be filed against you. most complaints have a 20 day time period to respond, so call your auto insurance or a lawyer today
