There are 4 requirements to proceed with a class action:

1. Numerosity – enough plaintiffs to make class action an efficeint way to handle the claim.

2. Commonality – common issues of fact and law for each claimant

3. Adequacy of Class Rep – the person who is the class representatitve needs to have claims that are the same as the class members and that they are capable of serving as the representative.

4. Adequqcy of Counsel – that the law firm representing the class has sufficient skill and resources to represent the class.

A certified class action suit is one brought on behalf of a large group of people as plaintiffs who have suffered some similar harm from the same actions of the defendant or defendants.

Here is my question:

Do you own a Honda Civic that has had the transmission go out? If so, please tell us about it here and include your thoughts of starting an organized class action lawsuit against Honda. Be as specific as you can in your posts about this matter.

Allow me to clarify: If there were problems with SEVERAL HONDA models, as the cited suit clams, then how are we to know whether or not the CIVIC is included, or should be included.

That is why I am asking….To gather information of Honda owners who may have had similar issues with the transmission.

I am only on a fact-finding mission and the internet is the fastest way to reach a lot of people.

Recently, the latest headlines indicate that about half a dozen law firms have filed class action lawsuits alleging that the company made false and misleading statements and ommissions and engaged in backdating stock options.

To be honest, I haven’t followed this lousy stock closely enough to know what is really going on. Is there any reason why I shouldn’t join the class action suit? How do I choose from among the various law firms representing plaintiffs?

I’m invested in a company that has a Class Action lawsuit against it. The company’s stock trades at less than ½ cash. Cash = 11 Mill, lets say other assets are worth 11 Mill more. Shares lost over 250M in market cap due to fraud charges

Insiders personally sold 20% of the company to very large firm days before imploding. Insiders, not the company got the money. The lead plaintiff in the class action suit is claiming a 3 million dollar loss. (The large company lost about 30 M as they bought at far less than the shares got on the open market pre-scandal)

So the questions are:
1) Will the other eligible shareholders receive the same ratio of compensation as the lead plaintiff (be that either by a settlement, or jury award) (minus legal fees)

2) Can I subtract the large company’s 20% from the pie that the Class Action people will share? (I’m guessing the large company can sue the insiders directly for their 30M)

Plaintiffs’ lawyers said consumers’ horror stories prompted the lawsuit. The class-action, filed in federal court in Washington state, alleges that instead of the new and improved services that Cingular promised AWS customers, Cingular immediately began dismantling and degrading the AWS network, forcing the latter’s customers to move to Cingular’s network.
