I was in a car accident that put me out of work and on workers comp. (Accident involved my car, and a crane owned by Sundt Construction) Workers comp has been paying the wrong amount since day one, and they won’t change it to the correct amount that I am supposed to get as stated in Az law. I lost my raise at work due to being out of work in a sales position, i’m also getting a pay decrease for not meeting the sales requirement due to being out of work. The car was repaired, but I am behind on the payments due to only making 1/3 of my normal income. I can’t pay any of my bills, and the doctor won’t release me to go back to work because I’m not better. If I don’t find a lawyer to help me I’m going to lose EVERYTHING I have. So I don’t really know what kind of lawyer I need. In the accident I suffered from minor neck/spinal injuries that require 13 weeks of physical therapy to repaire.
The accident happened 8/1/06. My car was parked alongside the accident site in a parking lot of a business. The car sat there until 8/26/06 before they actually towed it. Sundt paid for one week of a rental car, but I was left with the rental for one month while they repaired my car. I got my car back 9/25/06 and returned the rental car. I later got a bill from the rental company saying I owed for the rest of it.
Because of the accident I also had to drop two classes that I was currently in in college. I now have to do those two classes over, even though I was already almost completed with them, AND I have to pay the tuition for the previous two that I was forced to drop… There has to be SOMETHING I can do.

How can I best fight a traffic ticket when an accident occured?
I was involved in a traffic accident (no injuries) where I received a citation for improper lane change. I feel that I should not have been ticketed. The car behind me and I were both stopped at a construction site. We both went into the left lane around the construction at the same time. She hit my rear drivers’ side quarter panel with her front passengers side. The officer felt that I went into her lane and hit her. Her passenger side door would not open. The quarter panel was knocked back into the door indicating that she hit me. I thought that neither of us would get a ticket as it appeared to be a true accident with no one at fault. Even the officer said that he could not respond to an accident and not cite someone or he wouldn’t. He suggested that I go to court and plead not guilty. This involves my mother, 87 years. She was making a left turn and got into the left turn lane too early. An oncoming car blew his horn; my mother realized her mistake, moved into the lane on her right, then made her left turn correctly. Unbeknownst to my mother, the “oncoming car” followed her to her destination (a friend’s house). About two minutes later, a police officer came to the house and gave my mother a ticket for reckless driving. The officer said the driver of the “oncoming car,” who said he is a doctor, insisted that the officer issue the ticket to my mother. She has a court date on Aug. 8.
One, can a citizen insist that a police officer issue a ticket when the police officer wasn’t present at the scene of the “violation?”

Personal injury lawsuit against the city of New York, How much more time am I looking at to settle?
Hey guys, I was in a motorcycle accident in September of 2003. I crashed my motorcycle due to man made holes that were left uncovered on a side street here in NYC(construction). My lawyer tells me we have a strong case. I broke my femur in 2 different places and have had 4 surgery’s in the past 6 years. 6 months of physical therapy. My friends were kind enough to take pictures of the site while i was still in the hospital. According to my lawyer i owe my friends big time because the holes that were cut into the street were covered up shortly after my accident. there were roughly 8 rectangular holes cut into the street.. of which 5 were covered up at the time of my accident. there was a stack of metal plates that were once used to cover the holes across the street.. My friends took pictures of all this. As of today I have already been interviewed by the NYC lawyers with my lawyer present, I have been looked at by the NYC lawyers doctors to review my injuries. I guess now we are just waiting for a trial date. I speak to my lawyer every month and he keeps telling me the same thing, that the city is delaying as much as possible. He tells me to check with him every month so he can give me an update, which I do. He hasnt said anything to me about what amount of money we are looking at. Manhattan prosecutors are expected to announce manslaughter charges on Monday against the rigger who was overseeing the raising of a tower crane on the East Side last year when it collapsed, killing seven, according to people briefed on the case.
The rigger, William Rapetti, has also been charged with criminally negligent homicide, reckless endangerment and second-degree assault in the spectacular disaster, in which the 22-story crane plunged across East 51st Street, piercing one building and tearing terraces off another, the people said. The accident, on March 15, played out across a two-block swath of the Turtle Bay neighborhood, leaving two dozen people injured and the streets strewn with rubble.
The charges — including seven counts each of second-degree manslaughter and criminally negligent homicide — are contained in an indictment that is expected to be unsealed on Monday, the people said. Mr. Rapetti’s company, Rapetti Rigging Services, will also be charged, the people said. All spoke on the condition of anonymity because the charges remained sealed.
Mr. Rapetti, 48, of Massapequa Park, N.Y., was set to surrender on Monday morning, said his lawyer, Arthur L. Aidala, who noted that five of the seven people who died were friends of his client’s, men working with him on the crane that day.
Mr. Aidala said he was confident that Mr. Rapetti, an expert in the operation and rigging of tower cranes, would be cleared. “He did nothing wrong, and operated at that site in a way that is beyond reproach,” Mr. Aidala said.
The indictment, the result of an investigation by the office of the Manhattan district attorney, Robert M. Morgenthau, represents the first criminal charges stemming directly from a spate of fatal accidents involving tower cranes last year.

The second collapse, on East 91st Street on May 31, remains under investigation by the Rackets Bureau in Mr. Morgenthau’s office, the same group of prosecutors that is handling the case against Mr. Rapetti and that brought the corruption cases, one law enforcement official has said.
The two accidents, coupled with a series of disclosures about missteps by city agencies and others in the fatal fire at the former Deutsche Bank building in 2007, exposed the deeply flawed operations of the Buildings Department. In particular, the crane collapses focused attention on the department’s troubled Cranes and Derricks Division, where a handful of inspectors, some lacking in experience, were overwhelmed by the workload brought on by the city’s building boom.
The charges against Mr. Rapetti stem from what one person briefed on the case said were “reckless and negligent rigging practices,” which caused the failure of four nylon slings that were being used to hoist a huge square steel crane component to the top of the crane. The component, called a collar, was being moved to raise the crane higher to continue construction, a process known as jumping the crane.
Mr. Rapetti also failed to follow the crane manufacturer’s specification that the collar be supported by eight slings, the person briefed on the case said.
One sling had “substantial pre-existing damage, including cuts and severe dislocation” that would have been readily apparent to Mr. Rapetti had he inspected it before use, as the building code and federal regulations require, the person said.
When the slings ripped and the collar broke free at the 18th floor, it plunged down the side of the crane, smashing into a second collar and shearing it from the building before landing on top of a third collar near the crane’s base, destabilizing the tower. The weight of the crane’s cab then pulled the tower down.
In September, federal regulators accused Rapetti Rigging Services of failing to inspect the slings, remove a defective sling from service, protect the slings and comply with the crane manufacturer’s specifications when raising or lowering the crane.
Those citations, by the federal Occupational Safety and Health Administration, carried penalties totaling $220,000 and included three willful violations, the most severe issued by the agency.
Mr. Rapetti had been cooperating with OSHA’s investigation, said his lawyer, Mr. Aidala, who added that Mr. Rapetti came from a family of crane operators and had worked on the machines since he was a youth.

Police detained Herman Marzelo Vail Bailon for questioning on Saturday after they were called to an Oklahoma City motel room where employees had been asked to help a choking toddler.
But police say the presence of blood in the room indicated there was something more sinister happening.
Police arrested Bailon on a child abuse complaint. Doctors then noticed bruising on Liliana’s body and further examination revealed the girl’s skull had been fractured and that she had suffered other injuries.
Liliana died on Sunday.
Federal immigration officials later said that Bailon, a native of Guatemala, is illegally in the United States.

HOLLAND (Michigan)– An illegal immigrant who allegedly caused a fatal crash by turning in front of a motorcyclist was charged Thursday with trying to leave the scene of the deadly collision. Rodrigo Delacruz-Encarnacion, 25, is jailed on a $100,000 bond following his arraignment in Holland District Court on the felony, which is punishable by up to 15 years in prison.
Police say Delacruz-Encarnacion is responsible for killing William O’Brien, 52, of Holland in an 8 p.m. Wednesday crash. O’Brien was driving his 1996 Harley-Davidson south on Butternut Drive when the suspect’s minivan turned into the path of his motorcycle.
O’Brien could not avoid the crash, and struck the passenger side of the van. He died at the scene. His family declined to comment on the accident.
Ottawa County sheriff’s Lt. Steve Kempker said witnesses had to detain Delacruz-Encarnacion at the scene of the crash until police arrived. He was arrested and taken to the Ottawa County Jail.
The suspect has been in the country illegally since the spring and has been working odd jobs and living in migrant camps, police said. He allegedly had fraudulent identification when he was arrested.
Authorities believe Delacruz-Encarnacion is a risk for fleeing the area since he has no ties to Holland.

TOMBSTONE — A Department of Public Safety officer was assaulted by an illegal immigrant following a traffic stop Thursday, the agency said Friday.
The vehicle, which had been pulled over for unsafe lane use, stopped and then sped away as the officer approached the vehicle, stopping in a dirt pullout, according to the DPS. The driver, also an illegal immigrant, tried to run, then the officer tried to restrain him, at which time the officer was attacked by a passenger who attempted to choke him. After the officer broke free, the men fled.

Just last March, San Francisco police arrested Ramos on a gun charge and already had two other felony convictions before that. However, due to San Francisco’s “sanctuary city” policy, the city officials did not alert Homeland Security about Ramos.
According to San Francisco Mayor Gavin Newsom, “We are standing up to say to all of our residents, we don’t care what your status is in terms of legal certification.”
Since the shooting, Newsom has rescinded part of the sanctuary policy, but it is far too late for the Bologna family.

Deptford woman killed, illegal driver held on DWI, death by auto charges

FRANKLIN TWP. — A 51-year-old Deptford Township woman died Thursday from injuries she received when her car was hit by an illegal immigrant who was driving drunk and with no license, police said.
The crash occurred at about 5:35 p.m.
Mijail L. Hernandes, 24, of Lake Worth, Fla., was driving a 2000 Chevrolet Suburban west on Route 40 and allegedly failed to stop at a red lght, police said.
The Suburban hit a 2008 Hyundai Tucson driven by Yvonne M. Pennewell, which was traveling south on Main Road, Route 555, said police.
The Hyundai was forced off the Hyundai. Pennewell and her passenger, Crystal D. Ashmore, 25, of Vineland, had to be freed from the car by rescue crews. Both women were airlifted to Cooper Medical Center in Camden.
Pennewell died at Cooper. Ashmore was listed as being in serious condition, said police.
Hernandes was taken to South Jersey Regional Health Center in Vineland, treated for minor ijuries and released.
Hernandes was charged with death by auto, aggravated assault with a motor vehicle, unlicensed driver resulting in death, unlicensed driver resulting in serious bodily injury, driving while intoxicated, failure to obey a traffic device, reckless driving, unlicensed driver and failure to wear a seat belt.
Hernandes was committed to the Gloucester County Jail in Woodbury in default of $250,000 full cash bail.

Richmond police allege that Garcia-Hernandez was driving the truck when it ran off Snead Road and hit a parked car that spun around and fatally injured two people standing next to it, Jones, 44, and Joseph Owens, 40, of Alberta in Brunswick County.
Jones, a native of South Hill and the mother of two children, lived in the neighborhood were the crash occurred and was attending a house-warming party when she was struck, said Charles H. Cuthbert Jr., her attorney. She had been employed several years as a security guard for Wackenhut Corp., he said.
After the crash, police said Garcia-Hernandez, 28, tried to flee the scene on foot, but witnesses detained him until officers arrived. He was indicted June 9 on two counts of aggravated involuntary manslaughter, driving while intoxicated and felony hit-and-run driving.
According to the lawsuit, Garcia-Hernandez had a blood-alcohol level of 0.15, nearly twice the legal limit of 0.08.

KENANSVILLE — Two men targeted through investigations into methamphetamine sales in Duplin County are now in custody after separate searches at their homes collectively yielded nearly a kilogram of methamphetamine, $30,000 in cash and seven firearms.
One of the men, Benito Rayo Zavala of 3262 Hwy. 111/903, Albertson, is facing a long list of felony charges at the county level, while federal charges are pending against Ernesto Rayo Morales of 126 L.G. Westbrook Lane, Albertson. The men’s ages have not been confirmed by local authorities.
Morales is an illegal immigrant and Zavala is also believed to be in the country illegally, Duplin County Sheriff Blake Wallace said in a recent press conference. The sheriff noted that both arrests were made as a result of probes by the multi-agency Duplin County Drug Enforcement Task Force, which executed search warrants at separate homes in the Albertson area earlier this month.
Zavala was arrested on July 7 in the more recent case, when an investigation into the possible manufacturing and selling of methamphetamine culminated in a search of Zavala’s home.

My husband was involved in a vehicular accident after a woman ran a red light at a speed estimated at over 60mph. She hit the car next to my husband which was split in half and the back half of that car careened into him. My husband’s foot was crushed between that car and the motorcycle he was riding. But with the economic downturn the trades are laying off and he could very well end up back at the hall. Having this limp will definitely work against him getting a long term job, he could ended up digging ditches to put in electrical underground for the rest of his working life.
We know how much we will get for his medical bills and lost work time. We really hate to hire a lawyer, who would get 40% of everything, in fact, the union lawyer advised us not to. So what is the rule of thumb to figure up pain, suffering and permanent damage?

Why does GOD hate me?
I am a 24 year old Staff Sergeant in the national guard. I have been deployed twice now. The first time was to Bosnia, which wasn’t that bad. I returned, and started my own construction business. I had five guys on my crew, and we were very successful. I built many homes across the state I live in.
Then my second deployment started. I was forced to go after objecting profusely, but of course, that wasn’t an option. I had to push up my wedding and cancel my honeymoon to Australia. I had to sell the house I just built for myself, because I couldn’t afford it when not working. I lost my business. The only thing I did get to keep was my truck and the cabin my grandpa passed down to me when he died while I was in Bosnia. Not only was this a deployment for one year to iraq, it required me to change army jobs, which required about a year of train up before hand. My wife said she wasn’t going anywhere, and after a bittersweet honeymoon in Las Vegas, I had to leave. I only got to see her about 4 times before I went off to Iraq.
Flash a year ahead. I just got home from Iraq, and found out my wife had been cheating on me. Not only that, but she still was, even though I was home. She wanted a divorce. As a devout catholic, I objected at first, but then caved in.
Right after I got the separation paperwork from my wife’s lawyer (it was a very brutal divorce with many arguments over what/how to split things up) I went to my cabin with my friends, for a weekend of drowning my sorrows and doing other cabin things (atv, guns, etc). That first night when we got up there, we got into a brutal car accident, and I was in a coma for 14 days. I totaled out my truck, and was in a hospital for the next 3 months going through rehab.
I am now living in a crappy one bedroom apartment with no job, because I suffered massive head trauma. I don’t have a drivers license, because I can’t pass the driving test. Basic life skills are beyond me.
Right now, it is 930 in the morning, and I am considering ending it all. I’ve lost everything I’ve ever had in my life, all for my love of country. Please help me and give me some insight, not to mention a reason to live.
Brian- Yes, I forgot to change my clock. Since I do nothing but sit in my apartment and go get some groceries once in awhile, time really doesn’t mean anything.
modernday- I’m so brain damaged my idea of entertainment is to sit on answers and ask questions made up about people much worse off than me. On that particular day, that’s the best I could do.
