In June 4 2004 I was involved in a car accident. No summonses were given to any of the parties involved. I was driving my sister’s car, which at one point was living at the same residence as I reside in but moved out by January 2002. She open her policy sometime in 2001 and may have forgotten to declared me as a licensed driver living in thehousehold(not sure what was omitted). In 2006 I was served with a civil lawsuit. I turned the lawsuit papers over to her insurance company, by this time she had a different insurance company. They assigned a lawyer to be my defense counsel and deal with the suit. Sometime in July 2007, my sister insurance notified me that they were not going to be responsible for any liability cost or any future legal cost. The letter stated that they were now in 2007 voiding my sister policy dating back to February 2002 and gave no explanation as to why. It said I could appeal but the appeal’s process is ridiculous because is conducted by someone that works for
them actually by the same person who denied coverage the first time. Now I have to get a lawyer to defend me and try to get the insurance company to act responsibly as well as a lawyer so that they stop giving my sister the run around by not providing her a copy of her policy to see what section allows them to void the policy. By the way my sister had other claims that they answer for and they also collected almost 4 years of premiums. Are they allowed to do this and what can happen to me if I was unable to afford legal representation?

WOW.. now this is a mess. First off, the liability is YOURS and you probably should not have turned it over to them. Second, you should have checked the policy to see if you were on it. If not, as has been stated, you are personally liable. This really doesn’t make alot of sense. You turn the papers to your sister, even though she had a different company, so why would you do that? yeah, you got yourself in a real pickle. First, deal with the insurance company. Ask for a continuance in the civil suit. ONe lawyer should be able to handle this, but, its not going to be cheap. Sorry, but this isn’t going to be fun
If you lived with her at the time the policy was created, and she did not declare you as a resident, then they may have grounds for declining your coverage…
If they canceled the policy retroactive, she should be entitled to a refund of all monies paid.
File an official complaint within your state… for example, is the offical governmental site for complaints in virginia. is another states’ sight. Not sure what state your insurance is through, but there should be a branch of your states government to file complaints.
Better Business Breau is another place to file some complaints.
Everyone has a boss. Make the most noise, and climb the ladder up. Media can be your friend in this situation. Post stories on Youtube, news forums, and other insurance complaint websites. Be sure to mention the names of the comany and the employees who refuse to assist you.. Type up a press release etc and submit it to your local news broadcasters, with request for their help.
Some tv stations have journalists that do stories like that for their fluff pieces.
If all else fails… transfer belongings out of your name and file bankrupcy after the civil judgement.
