Is there a new law about settlements for Medicare recipients?
I am on disability from a car accident in 03 where I had a brain injury and surgery. Last yr I gave birth to my son. When he was 6 wks old I was sideswipped by a truck. I had whiplash and was in alot of pain for months. It was hard caring for my son, because the lifting and carrying him put strain on my neck.
I gat a lawyer to help me with the accident and a small settlement. I just called them, and was told that there’s a new Medicare law that says if I get any settlement over 1,000 I won’t be able to get medicare anymore. Is that true? I called Medicare and the woman talked with her superviser, and said they never heard of it. Now I’m worried. I’d like a settlement over 1000 to cover medical expenses, my lawyer fees and pain and suffering. But I don’t want to lose my insurance.
Has anyone else heard of this law? Where can I find it?

Abused in a graveyard
While the country was celebrating Christmas on Dec 25, 2006, tree cutter K. Kamalason, 47, raped a five-year-old child in a Chinese graveyard in Kuantan. He inflicted his young victim with extremely serious internal injuries to her uterus, intestines and private parts.
Kamalason is married with two children ages two and six and was sentenced 20 years in jail and 20 strokes of the rotan.
Her stepfather, her rapist
As a stepfather, Zulkarnain Ramle, 40, of Kampung Sourabaya Hulu, Petra Jaya in Sarawak should have protected and cared for his stepchildren. Instead, Zulkarnain raped his 11-year-old stepdaughter three years ago when both her mother and elder sister were not at home.
The child told her mother, who lodged a police report and her daughter taken for a medical examination. Zulkarnain was sentenced to 12 years in jail on Nov 3, 2003.
On her way to work
On Oct 7, 2000, computer engineer Noor Suzaily Mukhtar, 24, boarded a Metro bus from Kuala Lumpur to her workplace in Klang. It was like any other day during her two-week attachment at a medical centre in Port Klang.
After the bus driver, Hanafi Mat Hassan, 38, dropped off the last remaining passenger at the Klang bus stand, he changed routes towards Banting and pulled over at the Bukit Tinggi project site. Noor Suzaily tried to escape but the doors were locked. The windows were heavily tinted so she could not draw attention. Hanafi raped her and used her headscarf to strangle her before tossing her naked body out of the bus. His wife had just given birth three days ago.
Noor Suzaily was dressed in a long skirt and tudung. Yet police said the murderer claimed he tak tahan (unable to control his lust).
Bomoh dupes teenage dropout
She was 14, has dropped out of school, and living with her parents in Berenang, Kajang. When she started suffering from unexplainable pains in her legs in July 2000, her father, a retired soldier, took her to see a trusted family friend who was a bomoh. He told her she would die if she wasn’t cured of her elephantiasis disease.
He convinced the girl’s father to set aside a room in their house to perform special prayers and treatments which could only be carried out after midnight to cure her. Over three years, the bomoh undressed the girl, raped and sodomised her while her parents slept. Before the “treatments”, the bomoh had forced the girl to spiritually marry him so they could have sex. She warned the girl not to inform her parents as the treatments must be kept a secret. In July 2003, the girl broke her silence and lodged a police report.
The bomoh is learnt to have seven wives and was previously acquitted of a charge of conducting a marriage ceremony contrary to Islamic law at the Lower Syariah court in Malacca.
Bomoh dupes high achiever student
She was 16 and scored 9As in her PMR. Then she started losing interest in her studies in 2002. Her worried father, a businessman, brought her to a famous bomoh, as he believed his daughter has been put under a spell.
The bomoh carried out his services in a hotel room. For several weeks, the businessman sent his daughter to the bomoh and waited in the lobby. By the time, he became suspicious, his daughter had been raped several times.
The suspect reportedly has treatment centres in Pahang, Johor and other states. Police started a hunt for the bomoh who has since been on the run.
Consensual sex or statutory rape?
Thor Guan Aik asked the right question to his teenage girlfriend before having sex with her two years ago in Sungai Nibong, Penang, “How old are you?” She told him she was 16, which was old enough, so they had sex. She was actually 14 and the case went to court as statutory rape.
On Oct 18, 2005, a Sessions Court freed Thor of the charge, ruling that the couple had consensual sex. The girl refused to testify in court. The judge also ruled her evidence as contradictory to the doctor and investigating officers’ testimonies. His release prompted women’s groups to call for an amendment of the Evidence Act to allow videotaped evidence to be allowed in cases.
Raped after birthday bash
In August 2004, lorry attendant Jailani Budin, 21, was sentenced to 30 years in prison after pleading guilty to six charges of raping a Form Three girl after helping to celebrate her 15th birthday.
Jailani, who had two previous convictions for break-ins, took the girl on his motorcycle to three locations at different times. Although there was no element of violence, DPP Muhamad Iskandar Ahmad, pressed for the maximum sentence because he said rape offences were on the rise. Jailani’s wife was pregnant at the time he committed the offence.
The Nurul Huda Gani case

With her home just 300m from the Tenaga Nasional Berhad sub-station in Kampung Pekajang, Tanjung Kupang in Galang Patah, Johor Baru, little Nurul Huda Gani had probably passed security guard Mohd Abbas Danus Baksan, 46, before, on her way to the nearby grocery shop.
On Jan 17, 2004, Mohd Abbas was convicted of dragging Nurul Huda into the station, raping and then murdering her.
When she didn’t return home, her worried brother and two sisters came looking for her. She was found in a squatting position inside a toilet at the station.
On Aug 28, 2004, Mohd Abbas was sentenced 20 years’ jail and 24 strokes of the rotan for raping the child, and sentenced to death for murdering her. He maintained his innocence that another security guard had been the killer.
The serial rapist
In January 2006, Beh Soon Hock (pic left), 39, lost his appeal against a sentence of 60 years and 24 strokes of the rotan for five offences of rape, sodomy, robbery and theft.
High Court Justice Abdull Hamid Embong, who rejected Beh’s appeal, said he agreed that the sentences imposed on him by a lower court were appropriate.
Beh had raped a South Korean woman and sodomised an Irish woman and a 10-year-old Kuwaiti boy. The unemployed bachelor had 53 previous convictions mostly for theft, housebreaking and mischief committed between 1985 and 1996.
The pensioner who raped
In August this year, Mat Saad Md Isa, 61, was convicted of raping an eight-year-old in a house in Sentul in 2001. The judge ordered to serve his 19-and-a-half years’ sentence for rape and four-and-a-half years’ sentence for an indecent act.
He used a condom
A roti canai seller raped his daughter and paid her RM5 as a “reward” to keep quiet. Court of Appeal judges unanimously rejected the 49-year-old father’s appeal to reduce his jail term in June 2008, after the defendant’s lawyer said, in mitigation, that he used a condom each time he raped the child.
The man was sentenced to 36 years and 20 strokes of the rotan by the Shah Alam Sessions Court on Aug 20, 2004 after he pleaded to four counts of raping his 11-year-old daughter at their house between May 2003 and Aug 9, 2004.

Okay so it’s for a story I’m writing but I won’t bore you with plots and details I’ll just give you a background of the girl so you can visualize her.
She’s about 14 years old. She has long brown hair which she usually straightens and puts a head band in. She has an average skin-tone, she is Caucasian. She is around 5′0 tall and thin. She is shy and skittish on account of her history and has big blue eyes. She wears a little bit of make-up but only to cover the bruises. She is very mature and has only a handful of friends. She gets straight As and plays the piano well. She’s usually dressed in jeans and t-shirts unless it’s for school then she’s dressed in a white shirt, a blue and silvery coloured striped tie, a knee high grey skirt and a pair of black ballet flats with white socks.
Okay about her history. She’s an orphan to begin with. Her mother was an only child and came from a very stuck up rich family she attended the most expensive private school in district etc etc. She grew up a very sick child suffering from a heart condition she was born with, it’s hereditary and her twin sister died of it when they were a few days old. Her mother had hundreds of operations throughout childhood, was on a strict diet and exercise regime. She wasn’t allowed to run around with all the other kids or join sporting teams at school so she had no friends.
The girl’s father on the other hand came from a family of Scottish immigrants, he immigrated with his parents and younger brother. But unfortunately his parents died when he was 6 and his brother was 4 in a three car pile up (a semi was involved). He and his brother were sent to live in foster care and were never adopted. Both boys went to the local public school and neither had friends because of the fact that they were foreign orphans in foster care. The father was very clever and good with his hands but had poor hand-eye coordination and the only sport he could master was swimming.
The pair met at a local dance when they were both 16 and dated for 2 years until at 18 they decided to marry. The mother’s parents told her they would disown her if she married someone in a lower class (I know it sounds like 17th centuryish but that’s the kind of people they were). But they married anyway and the girl’s mother was disowned from the family.
At 19 the mother fell pregnant with the girl. It was a difficult birth and the mother suffered a cardiac arrest during childbirth and died, the baby almost did too. The father tried his best to make ends meet and managed to send the girl to a private school where despite being motherless unlike her peers she was happy. But when the girl was 8 her father discovered he had terminal colon cancer and died before he could figure out what happened to his 8 year old daughter. He died just after the girl turned 9 and the girl was put into foster care and lived with a nice young couple for about 4 months, the couple wished to adopt her but this wouldn’t be so. the authorities managed to track down her father’s brother a man the girl had only met a few times. He got custody, being the only biological family member left in the country.
Her uncle is a lawyer and highly successful in the world of lawyers and all the rest of it. But on the inside he is a bad-tempered man who drinks too much he is also a pedophile. He is very controlling over the girl, increasing her half hour piano lesson to an hour one and makes her practice an hour a day. He expects straight As 24/7, she is not allowed out with friends or to join any school clubs, he even controls how much she eats by weighing her food. He controls every tiny aspect of her life. She has to clean the house as well while he is either at work or in the living room drinking. Her punishment if she breaks one of his 250 rules (no joke) is being beaten, kicked in the head, punched in the face. He rapes her nightly and she is forced to wear make-up by age nine in order to cover it up.
When he gets especially mad at her he makes her do chores from when she gets home from school till about 10 pm then he beats her until she is barely conscious and bleeding sometimes with broken ribs and definitely heavy bruising. He drags her by her hair into the "Workroom", a room with concrete for floor and no furniture except a tiny window about a foot above her head (it used to store some of her father’s things, he was a hoarder). He leaves her in there with no food and water for a few hours and then comes back in and rapes her before leaving her in there sometimes for the whole weekend.
She is constantly coming up with excuses to explain her injuries, reluctance to be involved in school activities and skittishness. But anyway this is the girl and her history.

The Berg lawsuit against Obama was dismissed as frivolous last night – when will the kooks here realize that?
A federal judge in Philadelphia last night threw out a complaint by a Montgomery County lawyer who claimed that Democratic presidential candidate Barack Obama was not qualified to be president and that his name should be removed from the Nov. 4 ballot.
Philip J. Berg alleged in a complaint filed in federal district court on Aug. 21 against Obama, the Democratic National Committee and the Federal Election Commission, that Obama was born in Mombasa, Kenya.
Berg claimed that the Democratic presidential standardbearer is not even an American citizen but a citizen of Indonesia and therefore ineligible to be president.
He alleged that if Obama was permitted to run for president and subsequently found to be ineligible, he and other voters would be disenfranchised.
U.S. District Judge R. Barclay Surrick had denied Berg’s request for a temporary restraining order on Aug. 22 but had not ruled on the merits of the suit until yesterday.
Obama and the Democratic National Committee had asked Surrick to dismiss Berg’s complaint in a court filing on Sept. 24.
They said that Berg’s claims were "ridiculous" and "patently false," that Berg had "no standing" to challenge the qualifications of a candidate for president because he had not shown the requisite harm to himself.
Surrick agreed.
In a 34-page memorandum and opinion, the judge said Berg’s allegations of harm were "too vague and too attenuated" to confer standing on him or any other voters.
Surrick ruled that Berg’s attempts to use certain laws to gain standing to pursue his claim that Obama was not a natural-born citizen were "frivolous and not worthy of discussion."
The judge also said the harm Berg alleged did "not constitute an injury in fact" and Berg’s arguments to the contrary "ventured into the unreasonable."
For example, Berg had claimed that Obama’s nomination deprived citizens of voting for Sen. Hillary Clinton in November. (Berg backed Clinton in the primaries.)
Berg could not be reached for comment last night.
Obama was born in Honolulu on Aug. 4, 1961, and the campaign posted a document issued by Hawaii on its Web site, fight thesmears.com, confirming his birth there.
Berg said in court papers that the image was a forgery.
The nonpartisan Web site FactCheck.org examined the original document and said it was legitimate.
Further, a birth announcement in the Aug. 13, 1961, Honolulu Advertiser listed Obama’s birth there on Aug. 4. *

Army National Guard member disability/separation questions?

My wife is in the Army National Guard. While she was in basic training in 2006 she was injured. She finally got an appointment with the med board at Walter Reed in the August 2007 time frame and was found unfit due to her injuries. She has been told that she could not work but the military has been paying her INCAP pay for an E1. First off they skipped over half of August’s pay and never corrected it. Then they started going 2-3 months before they would pay her. Now she has not been paid since January 31st, 2008 and is owed almost 10000 after taxes. My wife just got a notice from the Army that her separation will take place on July 12th if no appeal was filed. It did not explain any of her benefits or entitlements. My wife just gave birth to our first baby boy on June 16th and we could use the money. I am afraid they are trying to screw her out of what they owe her. What should I do? Contact a private lawyer? fleeing class A misdemeanor probation from texas
i fled from deferred probation on two class a misdemeanor charges based on a plea deal and plea no contest, one was assault with injury(family violence) and the other was a violation of a protective order. i was sentenced to 2 years probation, 36 weeks of batterer intervention classes, 0 fine, and 100 hours of community service. i left due to my mother becoming seriously ill and them not granting me the travel permit. it has been almost 8 months now and they finally issued the warrants on 7/28/08. i know there is no statue of limitations, however i was wondering what the probability of them extraditing me from portland oregon back to texas. the bail is set at 7500 for each charge. during this time my wallet was also stolen and i have lost all forms of ID. i’ve been battling trying to get a copy of my birth certificate which i think i have finally been able to get. i’m also wondering if when i go to get a drivers license/state ID in portland if i will be flagged and detained. though i do plan on getting this resolved at some point in the future i have read numerous stories and posts of people going on with their lives for 10 years and never hearing about it again from texas/houston/austin. any information would be greatly appreciated. any lawyer i’ve spoken to has told me to just go get it taken care of, though that is not exactly an option right now due to the condition of my mother.
the charges are over 8 months old, the suspected victim did no press charges, it was taken by the state. the charge was for moving the suspected victim out of my way so i could get to my car and leave a neighbor called the police from hearing us yell, and the officer asked if i had touched her in any way that could have caused harm, the violation of a protective order came from me stating that i went to my own house to pick up some of my clothes to my probation officer…
So what will you all talk about now that Berg’s case has been tossed & we know Obama is a bonafide American?
A federal judge in Philadelphia last night threw out a complaint by a Montgomery County lawyer who claimed that Democratic presidential candidate Barack Obama was not qualified to be president and that his name should be removed from the Nov. 4 ballot.
Philip J. Berg alleged in a complaint filed in federal district court on Aug. 21 against Obama, the Democratic National Committee and the Federal Election Commission, that Obama was born in Mombasa, Kenya.
Berg claimed that the Democratic presidential standardbearer is not even an American citizen but a citizen of Indonesia and therefore ineligible to be president.
He alleged that if Obama was permitted to run for president and subsequently found to be ineligible, he and other voters would be disenfranchised.
U.S. District Judge R. Barclay Surrick had denied Berg’s request for a temporary restraining order on Aug. 22 but had not ruled on the merits of the suit until yesterday.
Obama and the Democratic National Committee had asked Surrick to dismiss Berg’s complaint in a court filing on Sept. 24.
They said that Berg’s claims were "ridiculous" and "patently false," that Berg had "no standing" to challenge the qualifications of a candidate for president because he had not shown the requisite harm to himself.
Surrick agreed.
In a 34-page memorandum and opinion, the judge said Berg’s allegations of harm were "too vague and too attenuated" to confer standing on him or any other voters.
Surrick ruled that Berg’s attempts to use certain laws to gain standing to pursue his claim that Obama was not a natural-born citizen were "frivolous and not worthy of discussion."
The judge also said the harm Berg alleged did "not constitute an injury in fact" and Berg’s arguments to the contrary "ventured into the unreasonable."
For example, Berg had claimed that Obama’s nomination deprived citizens of voting for Sen. Hillary Clinton in November. (Berg backed Clinton in the primaries.)
Berg could not be reached for comment last night.
Obama was born in Honolulu on Aug. 4, 1961, and the campaign posted a document issued by Hawaii on its Web site, fight thesmears.com, confirming his birth there.
Berg said in court papers that the image was a forgery.
The nonpartisan Web site FactCheck.org examined the original document and said it was legitimate.
Further, a birth announcement in the Aug. 13, 1961, Honolulu Advertiser listed Obama’s birth there on Aug. 4.
