Got bit by a monkey, can I sue the owner?

Sweetness asked:

In July I was visiting a friend that lives in an apartment complex. A woman there had a monkey for a pet. The monkey didn’t like ciggarette smoke so I went to my car and sat inside. The woman came over to my car, the monkey jumped in my car and attacked me. It bit my finger very badly and it ended up getting infected. I am still having problems with my finger being swollen and sore and think their may be tendon damage. I would like to get a lawyers advice as far as sueing this woman but don’t really know what my chances might be for winning this case. Since it bit me, it has bitten another person and the woman has to get this monkey out of Wisconsin as it is considered a dangerous animal. Should I see a lawyer and what are my chances of winning this case?

A dog in India accused of biting people was sentenced to death in a court of law?

Animal Bites Lawyer
tA asked:

A dog in India accused of biting people was sentenced to death in a court of law.

Police demanded the severe action but the dog’s lawyer claims the pooch only bites people trying to enter his owner’s house.

In court, the dog, named Chhotu, appeared to be on his best behavior. Despite the room filled with people, Chhotu’s lawyer says Chhotu didn’t bark or bite anyone.

The case continues and Chhotu is due back in court on August 5th but this time with his owner, a childless widow who lives alone with Chhotu.

The woman’s lawyer says her neighbors are just trying to get their hands on her property.

This isn’t the first time Chhotu has been in trouble with the law. A magistrate sentenced Chhotu to death in 2003 but animal rights activists managed to get the decision reversed.

What are my legal rights? In FL?

yesterday evening my neighbor shot my dog with a bow and arrow. We had to have him put down. My dog is/was raised with 2 kids, others dogs and cats. Not to mention all the people we have over all the time. He has never attacked or bitten anyone or anything. My neighbor’s story to the police is that my dog went into his yard while he was doing target practice with the bow. That my dog started growling at his 3 yr old son. That he shot at the dog and had no idea he actually hit him. The bow was going straight through his ribs, one side to the other. It looked to be a pretty well aimed shot. Is it legally ok to use deadly force on an animal for growling? Not lunging forward, not attacking, just alleged growling. The police are handing it over to the states attorney, but if nothing happens we plan on contacting a lawyer.
We do not believe that our dog went over there and just started growling at a little kid for no reason, if at all. The shot taken does not appear to be a self defense shot but a well aimed shot.
Ok, I did some research and then called local animal control. They have the right to protect themselves, property, and whatever. I think I should still consult with a lawyer.

Justine S asked:

So here I am reading at my house, and out of nowhere, my neighbors dog is continuously barking at something stupid. So I walk across the street and smack the dog, and she bites me. Now I am trying to sue the owners for owning a dangerous animal.(People shouldnt even own dogs). But no good lawyers will represent my case unless I give them lots of money, and everyone is making excuses for the dog. Its a Siberian Husky.

What legal actions can be taken when bitten by a dog?

pink_18 asked:

My 11 year old sister has been bitten by our neighbor’s dog and this isn’t the first time that dog bit someone. The dog bit her 4-5 times, punctured her skin and she had to go to the ER but didn’t need any stitches. She wasn’t bothering the dog or anything. It came from behind her and starting biting all of a sudden, on the sidewalk (not the dog’s territory), in the presence of his owner. (2 kids: approx. 15 and 11) We called a lawyer and he said he won’t do anything since the owners don’t have home-owner’s insurance and it’s going to take a long time to find an alternative and we should just call animal control and they will look into the dog’s history. But it’s that all? I don’t think they will take away the dog since it probably has all its shots and everything. So they won’t suffer in any kind of way. But my sister is the one suffering the most, she’s missing school, her leg hurts and its still bleeding and she’s also scared. Is there anything else we can do? My whole family is in shock because this is the first time this has happened to us and we usually try to avoid dogs because all of us are pretty much scared of dogs.
My sister is suffering so why shouldn’t they for not being able to handle their dog? They should face the consequences for endangering somebody else.
You can’t sue for pain and suffering in NY’s small claims court.
Animal control said they will have to go through a lengthy process which involves getting the report from the police, the hospital, etc. before they can remove or quarantine the dog. How long will that take?
Any other alternatives?

What should I do about a hostile neighbor?

Animal Bites Lawyer
Liddlebit asked:

This is a bit of a long story but hopefully someone out there can offer some advise.

I live in a small town to which we moved just over a year ago. I purchased my small home and live in the middle of the street with neighbors who own houses to my left and two rental houses to my right.

My immediate neighbor on my right is just great, but the one next to him on the corner lot is a complete loser. The other day I was on the front street with my small six pound puppy, who was on his leash. I had just returned from errands in my car and had the dog with me. I went to speak with my immediate next door neighbors wife who was out front watching her children play on the street. After speaking for a few minutes I walked away heading with my little dog on his leash toward my home.

The corner neighbor (Mr. A) had not closed his gate and his Rottweiller dog charged at me from behind and jumped to attack my little dog. I had seen him as I glanced over my left shoulder which allowed me time to scoop my dog from the ground to my arms. The Rotweiller while trying to attatck my dog managed to bite me fully on the stomach as I held my small animal away and in the air to save him from being mauled or killed. My dog was yelping in fear and squirmed from my arms falling to the ground in front of me where the Rotty tried to clamp down on him but not before I dove down and body checked the animal and grabbed it by its collar to restrain it. After doing this the wife came out to the front to see what the screaming and shouting was about and took her animal. The good neighbors wife had picked up my puppy and purse and took them to my house.

My dog was injured and needed to be examined by a vet, and I went to the hospital to have my wounds examined. The wife of this neighbor Mr. A came to my home after the event and apologized and said she took responsability and would pay the vet bills. I contacted the police and the SPCA and filed a report, but because I want to recover the $250 in vet fees I did not have them deal with it (a ticket for having an animal at large). I wanted to give them the benefit of the doubt, and allow them to make restitution.

This evening my mother and son were walking our dog on leash and walked past their home, on the opposite side of the street when Mr. A became verbally aggressive and started yelling that they should not walk our dog outside (this is on the other side of the road) . He was yelling and swearing and my mother (elderly) returned and told me.

I went outside and his wife was walking up the street returning home from work. I spoke to her and asked that she tell her husband not to yelll at my mother, if he has a problem to come and talk to me. He then stuck his head out the door and again became verbally aggressive accusing us of shining a flashlight in their living room window as we go by (we don’t shine it anywhere near their window and have taken to using a flashlight at night since the surprise attack by his dog). He then stated that our dog crapped on his lawn (he didn’t, and we always pick up and expect others to do the same), he then went on to say that we shouldn’t stand with our leashed dog on the corner of the road because it causes their dog to bark, and that I can wish on if I think they are paying our vet bill. I replied to him that was fine because he could count then on seeing me in court. I was after all bitten in the stomache and have wittnesses and photos to prove it. As well as my small dog having suffered deep tissue injury as a result of their negligence.

This is a really nasty situation and it appears I am not dealing with a rational person. I believe that town streets are free for all to walk on and that my dog who is leashed, licensed and in control has every right to walk whereever he wants with us, as long as we aren’t on their rental property?

This guy is going to make my life miserable since I expect them to chain their animal (one of two large dogs) and pay the damages we suffered. How should I deal with any future abuse from Mr. A? Do I need to tell the police, they already have taken the report on the initial attack on me from their Rottweiller. I don’t want anymore hassles from them and want to be able to walk freely with my dog in our neighborhood without fear of attack or verbal aggression.
Do I need a lawyer?

Ginny Hermione Ruls asked:

NOTE – everything is anonymous.

14-year-old A has had over sixteen pets in his entire life.
“I’ve had a hamster,” he said, “three or four rabbits, two dogs, many fish, and two chickens.”
But, apparently, those animals don’t get along with each other as well as he does with them. Once, his rabbit bit his dog’s tongue, and the dog, incensed, bit the rabbit’s neck. A big fight ensued.
His dogs are at two ends of the age line. #$@ is his 15-year-old mixed chihuahua, while his other dog is a 5-year-old Pomeranian named $#%@, which means little sister in Chinese.
As much as A likes domestic animals, he doesn’t seem to like insects very much.
“I’ve got an ant problem at home,” he said, “and whenever I get bored, I set them on fire, just for fun.”
He doesn’t belong to the Mosquito Fan Club either. “Whenever I visit China, I come back with huge mosquito-bites.”
A visits Guangzhou, China every other year. In the years in between, his brother, B, a junior at )@#% High School, visits China. After their long journey, they are relieved to see their relatives.
“We fly to Hong-Kong from either the San Jose or the San Francisco airport, and then we take a bus to the train, and then we go by taxi to our relatives’ house.”
The whole commute, including the twenty-one hour plane ride, takes about twenty-three and a half hours.
When they go shopping in China, their parents don’t let them speak in English. Speaking in English (or even in Chinese with an American accent) is a dead giveaway that they are “foreigners”, and the locals assume that they have more money. Because of that stereotype, the shopkeeper doesn’t let them haggle for lower prices.
Even though his mother’s side of the family lives in China, his father’s side of the family was born in California.
A was born in San Jose and has lived in Cupertino all his life. He went to $#% Elementary and $#%$FGD Middle School. Contrary to popular expectation, even though he likes animals, he doesn’t have his eye on a veterinary job. Instead, he wants to be a lawyer or a scientist, and plans on going to college to fulfill those dreams. He has also been learning the violin for eight whole years – over half his life!
“I took [the double] bass in orchestra, though,” he said. “I’ve learned it for about half a year. Even though it’s only a bigger version of a violin, it’s a bit hard to play, because it’s so big that it’s taller than me!”
Whenever he’s bored, A watches TV and chats with friends at the same time – a certain type of multitasking that is becoming very popular nowadays. But even with that modern pastime, he also likes something a bit more classic.
“I’m pretty good at card games,” he said. “Even if I don’t know the game, if somebody teaches it to me, I get the hang of it pretty soon.”
Even though A’s favorite subject is writing, he’s not a major fan of reading, other than random stuff on the Internet.
“If I wanted to look up something on Frankenstein, I’d search for it on the Internet and then read up on it instead of hunting for it in a book.”
But occasionally, he does flip through the dictionary, to “build vocabulary”, as he puts it.
“Hey,” he joked, “maybe next time I go to China, I can carry a dictionary along with me and read it while I wait for the plane!”
Let’s hope he doesn’t forget the mosquito repellant.

that’s it…thank you SO much if you answer this after reading the long paragraph!

3 year old bit by dog?

Animal Bites Lawyer
JENNAH J asked:

My daughter was playing outside and a neighbors dog jumped on her and dropped her on her back and continued to bite her on her arm. My husband grabbed the dog and tossed it. The dog then went to the neighbors front yard where their 2 year old daughter was playing and knocked the child on the cement on her face, busted her lip and gums and bruised her left side of her face. I called the police and the dog was trying to attack both the police and fireman. They finally got ahold of the dog and animal control took it. We found out the dog lives 3 homes down and the people let there dog outside to roam when they are not home. They left a ticket on the front door and the people are still not home. I think this person should be held responsible. I am really considering contacting a lawyer. Any suggestions? The police took several pictures and did a report.
I called her Dr. and we have an appt. on monday. The Dr. called in a perscription for antibotics to be sure that it doesn’t get infected.

Can I make neighbors get rid of dog that attacked my husband?

Can I make a neighbor get rid of dog that attacked my husband?
I need a lawyer to answer this, if you know Oklahoma law. My husband was attacked by a dog that dug a hole into our backyard and now we don’t want them to be able to keep the dog. No it is not a pit. Do we have to take them to court to order them to get rid of the dog? We don’t care if they keep it some where else we just don’t want it back on our block and neither do most of our other neighbors.
