For Lawyers: Question about the California dog bite law?
A friend of mine ( age 17) was sitting in her car one day behind her family’s restaurant and she was giving her dog some food. A girl ( age 20 or 21) who worked at the resaurant came out and aprroached the car. the girl commented on the dog and, without even getting permission from my friend, suddenly stuck her hand inside the car. Before my friend could react, the dog had bitten the girl. The bite wasn’t bad; no broken bones and the dog was vaccinated and everything. Even a nurse at the restaurant said the girl would be fine. The girl ends up threatening to sue my friend’s parents and their dog is going to be taken away. What can my friend do to keep them from taking her dog and without having to pay all that money? Her family can not financially handle all the expenses the girls mother is charging them for.

Dog Bite – Small Claims and Counterclaim. Two judgements? Or one minus the other?
I was bitten by my neighbor’s dog. I contacted a injury lawyer, and asked for settlement with their insurance company. Unfortunately, they refused to offer the insurance info.
The lawyer filed a claim against them, hoping they will give out the info. The neighbors claimed since they paid me for my medical bills, the matter is over.
The lawyer decided the case for not feasible for them, asked me to dismiss it and file a small claims case instead.
I filed a small claims case, and they file a counter claim for the legal help and filing fees from the first case with the lawyer, stating it was excessive/unneccessary b/c it did get dismissed.
If I win my small claims case, and they win their case, will the judgements be two seperate judgements, or will my judgement be reduced by the defendants counterclaim? It does seem like two difference issues.
And if it is two judgements, if I pay the judgement immediately, will it be on my credit report? Will it be treated negatively?

Do you know how much money you can get from a dog bite?
A few months ago,my wife and I had some people over one day for a barbeque. We have a huge fenced in back yard and I normally let my two small dogs play while we’re outside. Our neighbors dog,was chained up and going crazy because he saw our dogs playing. Their dog broke his chain and ended up jumping my fence and went after my dogs. I ran as fast as I could and grabbed both of my dogs,and their dog bit me in the back about 10 times. The owner finally came outside and took his dog in his house. I ended up going to the emergency room and needed 20 stitches and got bandaged up. Whenever we got home,we called my neighbor to see what he was going to do about it and he said,’Uhhh,well,it’s not like sombody dies or something so,nothing,I guess.” I told him that we’ll see him in court.
We called the cops,they came over,cited him,and took his dog. We got a lawyer and finally went to court. The court ruled in our favor,and since I had numerous medical bills,lost wages,emotional distress, and lifelong visible scars,that I would be awarded over $120,000,and after the lawyer takes his cut,I’ll get over $80,000.
The sad fact is,his homeowners insurance doesnt cover the breed of dog he has,and he never reported it to them. His homeowners dropped his coverage,and he has a FOR SALE sign in his front yard…I wonder why??

Neighbor Sues For 150,000 for Alleged Dog Bite Even After Owners Pay Medical Expenses. What are our rights?
Neighbor (also babysitter and friend) brought over her two children uninvited for a visit. The children ages five and two at the time. I was busy folding laundry and cleaning the house. The mother left her two year old alone with our sleeping dog age seventeen. Dog has been in family since age one and has never shown any type of aggression to anyone. The boy was injured and said “dog bit me”. We believe that he startled the dog in some way and then fell on coffee table. I took boy to emergency room with mother and waited while boy had ten sutures in forehead. (Scar is a perfect shape of the letter V). We paid all medical expenses/sent flowers and apologized many times) Neighbors are suing for 150,000 for personal damages. Our home owners will pay up to 100,000 but we are angry with situation. We are sick at the fact that people can sue even when parents should teach their children that you don’t bother sleeping dogs. Home owner’s lawyer said family will win something.

Dog bite to the face?
My husband was attacked by a dog while he was installing carpet at this guys house. Ripped his lips open in 3 different spots….Plastic surgeon had to close him up. He will have to have another surgery a year from now. Do any of you know of anyone that has been attacked by a dog in the face? We don’t have any clue what to settle for and do NOT want a lawyer involved being that they take 1/3 off the top.
