The people who said you need to sue her insurance company are wrong. You can’t sue them. They didn’t wrong you, she did. You need to sue her and then she gets her insurance to defend her. The problem is that if she wasn’t covered due to suspended license, then you will only be able to go after her personal assets which may not be much. You need to speak to another lawyer.

That said, as someone else mentioned, it sounds like you need to calm down some. If you are having uncontrolled fits of crying and such that could just as well explain your daughters emotional and bowel problems. So, the claims adjuster was in your car. Unless he took his pants off first, I don’t see what the big deal is. He needs to fully inspect the car.

While I realize that this was traumatic – the first thing you need to do is calm the heck down. Your daughter go frightened and some minor injuries – but she is still with you and she is going to grow up just fine. She’s traumatized – the same as she will be one day when she falls off her bike or slips on ice. Kids are more resilient than we think – as they say “this too shall pass”.

I don’t know what kind of lawyer you spoke too, but you need to contact a personal injury attorney and speak to them directly — most offer a free consultation and contigency fee plan.

No this wasn’t your fault, but yes accidents tend to put a wrench in our daily happenings. You will just have to deal with it and move with the system.

I don’t know what crackpot lawyer told you that you couldn’t sue, because that’s the type of thing that auto accident personal injury lawsuits were made for. Contact a NEW auto accident or personal injury lawyer and file a complaint against this woman right away. If you can’t find one in the yellow pages, call the bar association in your area for a referral.

Hopefully you contacted your own insurance company. They should be the ones working with her insurance company – that is what you pay them for. Good luck – I hope your baby is ok.

1… When the woman left the scene, she should have been charged with FELONY HIT & RUN…..

2…You will have to SUE the womans insurance company to get your money back….or car fixed…..

3…Unfortunately the medical difficulties may not be a provable thing….. Your child will probably have some trauma issues with being seatbelted in for a long time to come…..
Contact a lawyer to find out your options…. that is the best course of action that I could advise.

You need to get a lawyer. Her insurance company (if she had it) is responsible to pay for your damages. If she did not have insurance you can sue her in civil court. I wish the best for you and your children.

That is definetly wrong and something should be done as soon as possible. There were injuries involved, that’s definetly something. There are 1000’s of car crashes who sue people when no one was injured anyway. But in this case, it’s a baby, none the less.
