My moms was in a car accident! Not her fault, her car was totaled.should she get a lawyer?

My mom was driving home and out of nowwhere this guy broadsided her. He was on his cell phone and ran a stop sign. He had no license and was in a company vehicle. My moms car is totaled and she can no longer afford the rent a car. should we deal with his insurance ourselves or get a lawyer??

    I would get a lawyer, just because the company that the guy worked for is also liable (for letting this guy use their car without a license), as well as him (for the phone and running the stop sign), and companies can play hardball with stuff like that. You need a good lawyer who will fight hard for you.

    But it seems like you have all of your ducks in a row, and like you have a good case, so I’m sure you can find an attorney who will take the case with no money down. If you can’t find one in the yellow pages (accident or personal injury section), call your local bar association for a referral.

    Get a good lawyer, in most states if you cannot afford it you may qualify for free legal aid. Also contact your insurance company, they should help with any out of pocket expenses for a rent a car and any other expenses. Your insurance adjuster should have come out and determined if the car was a total loss and if it was cut your mom a check, or do you not have insurance? We are not getting the whole story here and cannot totally help you unless we do. Sorry~!

    the company’s insurance should already be taking care of this….you should not be putting out money for the rental, they owe that and they should settle on the worth of her vehicle. as far as personal damage you probably need a lawyer

    Holy CRAP! GET A LAWYER. Not next week, not tomorrow, NOW!
    There are a number of issues here.
    (1) The guy was driving a company car. This means that not only is he on the hook, but his company (who probably has much better insurance) is too!
    (2) It was totally his fault, but the lawyers for the other insurance company will try to screw you, because you don’t know what the settlement value of your case is, and you’re not a lawyer.
    (3) Having a lawyer means not having to deal with the paperwork, the calls from the insurance companies, and the stress of settlement.
    (4) Why is your mom paying for a rental? If she has insurance, your insurance company is supposed to provide a replacement (they can always go after the other guy for “contribution”). Your lawyer can see to it that your insurance company lives up to their promises, too.

    DO IT NOW!

    P.S. Almost all lawyers who do this work do it on “contingency fee” — meaning that they don’t get paid unless you do. The only thing you have to front is “costs” (like filing fees, copy costs, etc.) Call your local bar association and ask for a plaintiff’s personal injury attorney. Ask around, there are certainly people who know the good ones from the bad ones.

    You don’t need to deal with anybody, your mother insurance is the responsible to solve the problem. Her insurance is responsible to pay your mother losses and then take all actions required against the insurance of the car who is responsible for the accident. I’m imagining your mother has an insurance, if not, so get a lawyer as soon as possible. You don’t have any risk of losing money, but any wrong action can delay the process.
