If you get in a car accident, should you get a lawyer?

My partner was involved in an accident with a dump truck. This happened a month ago and there still hasn’t been anything done. She still has no rental car, no check for a new car (hers was totalled), no compensation what so ever. She doesn’t really have any injuries, and that isn’t the concern. Should we get a lawyer to help us? The first question they always ask is about injuries. Do they help if there aren’t any??? She is calling daily (multiple times a day) and is still getting NO where. We need this situation taken care of. Legally, what can be done?
Ok, I guess I left out some info…
My partner was not found to be at fault. The police officer found the other driver to be at fault. The police were called right away, and the insurance company was called right away. Her insurance company is doing nothing! Regular calls are made to Allstate (her insurance) and they keep telling her they are waiting on the other insurance company. She doesn’t have collision coverage because her car is older, paid off, and she didn’t worry about. So, her insurance doesn’t cover her rental car. She is being told they have to wait to see if the other insurance company is going to cover it. Finally after 3 weeks of making calls and getting no where, we finally get a call that the claim was JUST filed with the other company. We have been calling for 3 weeks to her insurance and they just kept telling us everything had been filed, and that they were just waiting. She did go to the doctor right away. (within 24 hours)
Also, within the past week we have been in touch with the other persons insurance company. Still getting NO WHERE.

Insurance Claim – To hire a lawyer or not???

Is it generally a good idea to try to solve the calim yourself with the other insurance compnay and if a resolution can’t be reached, then hire a lawyer?
Also, if I want to solve the claim on my own, I would have to hand over medical documents and such to the other insurance compnay. How might this compromise my case?
I have full coverage throught AllState, but not medical coverage, and hence was told that they won’t handle the medical part or the pain and suffering part of the claim.

Girlfriend was in a Car accident, Lawyer question?

My gf was in a car accident few days ago .
The car bumper was hit by a guy who was driving without a license.
It wasn’t too bad. But the bumper must be replaced and the insurance company should pay for the medical bills .

My question is this. I have "never" been in such a situation before , there fore I have some questions… because she doesn’t seem to know what to do either . She made some mistakes. She already contacted a lawyer , which she thought was the right move.
But i don’t think it was needed because this just happened a few days ago ,Aren’t lawyers needed when things get out of hand or when – they refuse to pay?

In regards to payment.
2 questions –
1) How should I approach the other company (All State ) in regards to payment.
The car was insured under some other person. Isn’t the guy who drove the car while the accident occured still responsible to pay her? ( i am worried , if allstate is making her run around and finally say – oh, we are not responsible !, the guy who drove doesn’t have all states, SORRY! )Another thing – They were forcing her to go to their own shop to get an estimate for bumper repair, does she "have to"? She wants "honda" to fix it and therefore go there to get an estimate, which i think she did. How much of this does she have to comply with AllState.?

2)
In regards to medical bill , how does this work ? Isn’t the doctors bills, any medication , and physical therapy all covered by the other person? If so what if it’s an ongoing procedure like, a physical therapy session for 8 months . What is the procedure for this ? Should she just fax all the bills to All State or wait till everything’s over and then fax everything- Estimate ( for bumper) and Doctors bill to them?

p.s: The lawyer told her to go to that doctor, I know how cunning these lawyers are . I want this to be done without any lawyer present as smooth as it’s possible. I am just worried if she’s going to get into any kind of trap. Please help.

I have never liked and do even less now “Insurance companys of any kind” we give our money without a fight every month and have to fight to get a “small portion” back when we need it. So PLEASE no more answers from Insurance agents!

I was in an auto accident on January 14, 2008. My husband, 3 week old son and 2 year old daughter were also in the car. We were stopped behind a stop sign and a driver who was not paying attention lost control of his vehicle at 75 mph and rolled half way on top of us. My son, daughter and I were all rushed to the hospital by ambulance while my husband stayed at the scene. I was the only one in the car who was seriously injured so we hired an attorney for my case. We settled within a couple months for my son, daughter and husband for $3,500 each. This put about $1,000 in pocket per person for pain and suffering. My PCP recommended I treat with a Chiropractor. I did so for 4 1/2 months before finally being released from his care. The other person’s insurance company immediately accepted responsibility as they reimbursed my deductible for my totaled car immediately. He only has minimum liability which in Arizona (where we live, and the accident took place) is 30/15 $15,000 max for property and $30,000 max for personal injury per accident but it’s only $15,000 per person.

I met with my attorney and we discussed how I have under-insured/uninsured motorist coverage. I finally finished treating and the lawyer just evaluated my case at a min. of $13,000 and a max of $16,000. They take 25% off the top then my $6,000 in medical bills get paid out.

This to me seems low. I couldn’t lift my arm to hold my 3 week old son because of the muscle spazams in my back. And I’m only going to get $4,000ish in pocket when we got that without an attorney for my family who suffered NO injuries?! Help me before it’s too late! It sounds as if they’re only dealing with the other guys insurance company, though AllState, my insurance company, contacted me months ago letting me know they’re awating a claim to be filed with my under-insured motorist coverage.
