Can my lawyer hold my money in a settlement case once the settlement check has arrived?
I know this question is a little long but for anyone who can help me out in this situation it will be HIGHLY appreciated and hell if i can go get my money maybe i will send whoever gives me the best answer a few hundred $$$ for helping me out here.(so anyone who thinks they have a good legitment answer to as how i can get my money leave your name and address and if i receive my payment you will be taken care of for your help… seriously thats how much this means to me). Ok i have a question for all you lawyers and/or aspiring lawyers in law school… Im going to type this short letter that i received in the mail yesterday and i’m hoping someone here can help me out with the question i have..
(By the way this settlement is coming from a car accident i was in which was not my fault…. A woman hit me head on and shattered my femur and totaled my car)
Oh yeah and by the way if it helps I live In Ohio, the car accident happened in Ohio, both people involved in the crash are from Ohio, and both insurance companies innvolved in this settlement are from Ohio because i know laws differ from state to state. Dont know if that information will help you guys in your answer but i figured id let you know.
Here is the letter i received:
Dear Paul:
I have tried calling your home and cell phone with no luck. Please get to me the information requested in the enclosed letter from Allstate. We have a check in our office for ,500.00 and need the enclosed information before we will receive the remaining ,500.00 from Allstate.
You will need to stop in the office and endorse the check so we can deposit it in our trust account until the claim is settled.
Thank you in advance for your cooperation in this matter.
Heres the deal… i am going to go get all of my medical records that my lawyer requested today (from the hospital and medicaid). So what that letter is trying to tell me is that once i take this medical documentation into his office and endorse the check i will be able to get some of my ,500.00 if not all of it.
I was just curious as to whether or not my lawyer could legally hold my ,500.00 in his trust fund just so he can draw interest on it? I mean i know the money is there and i know it is mine (all accept the surplus ,500.00 that is being held for medical records/bills) so is he really allowed to hold the money that is not set aside for medical bills in his trust fund just so he can draw interest and extra money from it because i know that is what will be done with it.
I have talked to a couple people that just got settlement money and they said their lawyers told them that the money was in his "trust fund" but they also told me that when they told their lawyer that they know the money is theirs and is their for them that their lawyers would give them some if not all of what they ask for to catch up on bills or what not that occured while they were down due to their accident.
So PLEASE help me out here guys i dont want to have to wait on my money any longer than i absolutely have to because since my car accident i have been unable to work and everything is going to hell…. just need to know if my lawyer is trying to screw me so he can draw interest on my money or if i should be able to receive some if not all of my ,500.00 check that is already on my lawyers desk… PLEASE Help me out here guys

My lawyer is asking me to tell my medical insurrance to pay for medical biolls from an accident, why?
I don’t understand I think he is lying about the settlement amount. Do I have a right to know the exact settlment amount. What would be the best way to find out the total correct settlement amount.

Hi I’m Keidi :) I was in a bad car accident last summer. I was not in fault the other guy ran a stop sign and hit me from the side my car was totaled. I suffered severe back and neck pain and my right shoulder was injured thankfully no surgery was needed. I was out of work for six months. I asked my lawyer and he said he does not know how much. How should my lawyer be handling my personal injury case?
I was in a car accident 10 months ago and after two days of talking to his insurance company I immediately called a lawyer. My car was totalled, it was 100% his fault (I have police reports to prove) and I have missed countless days of work and am still in pain. I went to three different types of doctors, had x-rays, mri’s and all sorts of tests done but i still have no use in two of my fingers, numbness and shooting pains. My last chiropractor released me basically saying there was not much more I could do and had to live with it. I have been told to see a neurologist but none will take me without insurance, or just based on my lawyer information.
I told the lawyer to just go ahead and start proceedings. She said they will come up with a demand. I dont know how this is all supposed to work but I want to make sure they are doing things RIGHT. I don’t want to get screwed just because I dont speak the legal jargon. If anyone can to tell me what to expect at this point, or what I can be doing or the lawyer should be doing that would be very helpful.
how can i file a defence without a lawyer ( UK )?
for a motor car accident case, where i am 1st def, my insurers are 2nd def, however they are covering me, so i need my own defence…..and the lawyer is charging almost twice as much as the claims worth to even follow the case…
