What do you think we should do?
well my uncle and 2 cousins work for a fire department in another town and they are required to move all victims with neck injuries with a neck brace. Did walking in the hospital cause her any damage..We are not sure, but if she had a spinal cord injury and she move wrong she could be paralyzed. Again my uncle and 2 cousins are required to think the worst until they do tests at hospital. Also yes we do have an onstar subscription, Not the full package, but we do have accident assistance.
to Ben: FYI we have never sued someone…ever. We aren’t some sue happy family, but we feel that alot of stuff went wrong.

When she asked for help from the nearest nurses station, the head nurse said, ‘well whiplash I suppose’.
And then proceeded to tell her that they were not equipped to handle
those kinds of accidents because they were a cancer hospital.
She did give her a bandaid, which did not stop the bleeding. When she
complained, they sent her to a patient advocate who works for the hospital.
Because of the fall, she will need new glasses for which the advocate said the hospital will re-imburse her. Then they did finally patch her face and head wound up and took exrays and found no broken bones.
But my sister is 61 years old and will no doubt have residual problems from such a nasty fall.
She doesn’t want to file for millions of dollars like some would do through a lawyer.
But she would settle for something for her pain and suffering and any further treatment she may need as a result of the fall.
Can anyone advise…….

I was recently involved in a car accident. Someone ran a red light & hit the front drivers side & her back end swung around and hit the back drivers side of my car going about 40-50 mph totaling my car. I was rushed to the ER before I could get any of her information & the police officer was supposed to come to the ER to talk w/me & give me a police report #, He never came, but there were 3 witnesses that talked to him stating they saw the whole thing & she ran the red light. I have no information about her, her insurance hasn’t contacted me, & I am waiting on the police report. My insurance has covered for a rental car for now.

My 6 month old son was in the car with me, the paramedic checked him out & he has had a followup with his Dr. & they said that he looks fine, but it just shook up. My head hit the steering wheel & slammed against the window. I have a bump on my head that is black & blue & my forehead and whole left side of my body is bruised. I have had a constant headache & my neck, back & body is all stiff & is in a lot of pain. I followed up with a Dr. but he told me that I am just telling myself that I am in pain, he looked at the floor the whole time & he would not even look over me. I am in the process of going to another Dr.

I have never been involved in an accident to this extreme before. Should I get a lawyer? or should I just try to work with the insurance company myself?

There were only two of us and he was going straight on a red light but by the time the policemen came, he reported as the incident is unresolved and it’s not one’s fault because both sides claim that they had a green light. It was his fault apparently ’cause he went on a red light and “I” on the other hand, had a “green arrow” not a green light where i should be yielding to him. And so, I went to get a lawyer and they told me that I only have 50/50 chances. Which makes me mad because I was the one who got injured badly and my car got hit pretty badly as well.at the end it’s hard to determine since I ended up being behind his car. Do you think i’ll win this case?
it was the Left green arrow by the way. And he hit me the corner ( on top of my front rear wheel)
He’s a new driver and he got his driver license the day before the accident. He’s around 17 or 18 so does that help?

there is a 4 way intersection inside my church parking lot there are no Stop signs and the only things are crosswalk looking thing with narrow yellow paint, painted in diagonal on all 4 side at where the intersection meets.

i came to a complete stop and as i stepped on the gas to go forward, a car hit my divers side. i did not see the car at all and it literally came out of nowhere. my car is a mini van and the other persons car was a corvette with two passengers, and mine a ford winstar with 6 passenger ( all including the driver) . the Corvette hit my drivers side wheel and my car was pushed to the right about 2 feet.

the wheel is at a angle about 70degrees?

a police report was made. i called my insur comp and they said that because i have liability ( not full coverage) they cannot do anything and that i have to call the Corvette’s insur and handle everything myself..

who determines who is at fault? i need a car because the van is currently un-drivable. what should i do? do i need a lawyer?

I’m in desperate need of advice. I have a two year old yellow lab. He is the BEST dog in the world and I love him so much. To lose him would be an indescribable loss for me. It all started when we were taking him to a friends house. He was jumping in the car (took running start to jump high enough to make it into the truck) when he smacked his head on the steering wheel. He fell on his back and slid under our other vehicle. He was dazed and wandered next door (no he wasn’t on a leash and I will regret that for the rest of my life, but he always jumps right in the car). He was sniffing around when our neighbor saw him. She is about 70 years old and she started screaming hysterically when she saw him. As he was dazed, he was probably really scared that she was screaming and thats when he jumped up and bit her on the back. Now we have to go to court and if he is deemed a “dangerous” dog. There are so many liabilities against us if he is deemed dangerous….not to mention we won’t be able to take him from the yard. If you are a dog owner you probably know the anguish of giving your dog up. It makes me nauseous. I would rather move than give him up. He has a great home with us and is very loved. Nothing like this has ever happened before. I’m assuming it was more of a play bite than a “I want to attack you bite”. Kids put their hands in his mouth and he doesn’t bite. He sees strangers constantly and doesn’t bite. I don’t know what to do. I talked to a lawyer and he is not being very promising which I know is not his fault. We put him in obedience school and have built our fence up to ensure no way of him getting out (which he has never done, just built it as a precaution). He isn’t dangerous and anyone who has a lab can probably vouch that they are hyper, but docile dogs. Any advice would be appreciated. I’m staying as hopeful as possible.

My medical bills are mounting and while my car insurance and my health insurance are covering them for now, they have both stated that if I settle with the other party that I am to reimburse them immediately out of that settlement. I just heard from the responsible parties insurance company who has said they are willing to pay the maximum amount of the policy limits – which happens to be the lowest possible amount allowed in Georgia, $25,000. This will barely cover what I would currently owe back to my car insurance and health insurance companies, but I would have nothing for further treatment and certainly nothing towards pain and suffering. The insurance adjuster for the responsible party stated that I could get a lawyer if I wanted but there is no way I can get any more than that 25K offered – does anyone know if that is true? I am not looking to “make money” off of this but I would like all of my medical bills to be covered and feel pain and suffering is not unreasonable as I almost died,

Would appreciate anyones advice on if a lawyer could seek out more than the policy limits. The person who hit me does not seem to have any additional funds if I were to sue them personally, I sense that would be an effort in futility.
I appreciate the advise on uninsured motorists – the adjuster from my company has said it does not apply, A) b/c the other driver had insurance, even if it was not enough and B) b/c they filed my claim as comprehensive, not collision. The at fault parties car did not hit me directly – they lost a wheel while driving down the interstate, that wheel crashed through my windshield and roof hitting me in the head. I’m grateful to be alive but absolutely infuriated that I pay for uninsured motorists but yet my adjuster will not let me file a claim for it. Could he be lying to try and save money for his company?
Regarding paying back insurance – I have received letters that I am responsible for paying back health insurance directly from my bodily injury settlement. Am I able to not pay them and pay myself a “fair” amount for pain and settlement or save it for future medical bills? (Not sure how fair would be determined though). I just don’t want to end up being sued for insurance fraud for keeping my settlement instead of paying back insurance. I’ve been told by various adjusters that in most states insurance would go after the at fault parties insurance on their own, but that in Georgia I am responsible by law for paying them back immediately after reaching settlement. It doesn’t seem fair if the settlement doesn’t cover those bills.
