false allegations, counter charges?
if person A presses sexual assault charges on person B, than it is later found out that person A is lying, what can person B do in means of sueing them? I.E. defamation of character? lost wages? lawyer costs?i would like to know anything and everything PLEASE.

I was on Judge Joe Brown show, and i want to sue them for defamation of character but dont know how to get started. I live in VA but it was taped last month in LA. The jist of my case is that they said on national TV that i have a manslaughter charge, which is totally false. I do not have any such charge nor have i ever been accused of anything of the sort. Its on principal that I dont want the nation thinking im a killer… Please help!

I think I have a case for libel/slander and harassment, but I’m not positive. Somebody has been harassing me for over 2 months now – text msgs(I had to change my cell #), on my myspace account (they are now blocked), and they actually called child services on me, telling them bulls*** about me to try and get me in trouble. I have proof from child services that all the claims were false. The things said were: I am a drug addict, that I made a sex tape with my child present, and that I take my child to bars with me. As I said – none of this was true and I have proof. Do I have a case for defamation of character or slander?

my Ex-girlfriend has stated to the community that I raped her and one of her friends and also posted a bulletin on my space saying that I am a rapist and also one of her friends is stating that fact that I raped HER and I was wondering how to go about dealing with this because most people that they told believe them and want to kick my *** so I don’t know how to go about this because I only want to press charges for defamation if they involve the police witch they won’t because the statements are untrue and that the possibility is very high that they will lose in a court of law but they don’t need to because all they have to do is let the people they told beat the **** out of me, Also I have a question about moving to another state while waiting for a pending charge for felony vandalism and I am 17 and 1/2 and with the rumors going around town I actually fear for my life and I’m pretty sure that if you fear for your life you can move. And with the vandalism I’m just awaiting the letter telling me when to be in court and I didn’t need bail I just had to sign something saying that I’ll appear in court and they released me to my dad.

Question out of curiosity.
In cases of defamation of character/slander/libel the plaintiff does not have to prove that the accusations are untrue but it is the defendant that has to prove that the accusations are true? is it correct?
The plaintiff can persuade the judge by providing evidence that in fact, the accusations were false but in general, does not need any more proff other than the fact that the defendant has no evidence?
If so, even if the defendant was telling the truth, it’s still slander/libel because the defendant has no evidence that the statements they made true?
Does it depend on the state/country?

How do I prove he is guilty of stalking and harassment?
I have been harassed for several months now by someone, but I can’t connect the calls to him in any way (I KNOW it’s him, though). He pays for satellite phones and is very rich. His family is also full of lawyers. I approached them to ask for help but they refused to believe it was their darling son, even threatened to sue me for defamation of character.
I have gone to the police and filed two reports on two separate occasions. They tell me there is nothing I can do so long as I have no solid proof. I would record his calls but as of late he hasn’t been calling me directly, only calling the police and sending them to my house (saying I’m going to kill myself, others, etc.).
What can I do?
Also, can I file a restraining order for this? Do you think a judge will okay it? He has threatened family and friends and swears to follow me until he "gets" me. Again, how can I prove it is him at the hearing for the restraining order?

I think I have been a victim of fraud, or conspiracy to commit fraud, while denying me legal assistance, using us to assist others. More than once. The Bar Association did nothing.I believe I saw attorneys to
file cash generating lawsuits, who listened, took the information and helped others with it. They then insulted me. I was not assisted. I was never in any way advised or given any advice whatsoever. I never received anything, nothing. Nothing I own was settlement for a lawsuit. Everything I ever owned was
settlement for nothing. It would not touch what was done to me. I was then hired for the purpose of contriving counter suits so that if I got anything they would get it. They also tried to give me HIV. I have been blackmailed. Threatened. Attacked, battered.
I am not a church member. I was not a church member when this was done. I think, honestly, the people I went to church with once, were spying to see what I would say. Alleged that if I saw an attorney I might say something bad about them. If Icould have

had doctors proposition and insult me. Had the wife of one to let me know someone slandered me. My husband and I were not planning to file bankruptcy and as far as I know, no one did. We certainly would have had a lot more debt if we planned to do so. That would have been the crooked thing to do. I have never bought anything in my life planning to file bankruptcy. Do you think Sharpton will actually sue Limbaugh?
Radio talk-show icon Rush Limbaugh was angered earlier this week. He felt that there were words attributed to him that he had never said. He said claims of controversial remarks about slavery were unfounded, and he felt he was unfairly dropped from a bid to buy the St. Louis Rams.
Limbaugh took to his radio show to defend himself, but he didn’t stop there. On Saturday, an op-ed piece written by Limbaugh appeared in the Wall Street Journal. But in that article, Rev. Al Sharpton believes Limbaugh crossed the line.
In the op-ed, Limbaugh attacks Sharpton, who was critical of Limbaugh’s involvement in the Rams bid.
In 1998 Mr. Sharpton was found guilty of defamation and ordered to pay ,000 for falsely accusing a New York prosecutor of rape in the 1987 Tawana Brawley case. He also played a leading role in the 1991 Crown Heights riot (he called neighborhood Jews "diamond merchants") and 1995 Freddie’s Fashion Mart riot.
Sharpton quickly responded, making it clear he did not appreciate Limbaugh’s words.
"I am definitely going to prove he makes reckless, unaccountable statements," Sharpton said. "Which is why he was forced out of buying an NFL team in the first place."
If Sharpton sues Limbaugh, it will be interesting to see if it gets very far. Both men have plenty of money and access to top lawyers, and it doesn’t make much sense for this to drag out into a long legal battle.
Limbaugh has gained a lot of publicity over his failed attempt to help buy the Rams, and there’s no question he will — at some point — address Sharpton’s comments on his radio show.

Sharpton and Limbaugh are both jerks, it astounds me that anyone would have a positive opinion of either one of them.
